Cleaners St John's Wood Service Terms and Conditions
These Terms and Conditions set out the basis on which Cleaners St John's Wood provides professional cleaning services to customers within St John's Wood and surrounding areas. By making a booking, whether online, in writing, or verbally, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following definitions apply:
1.1 Company means Cleaners St John's Wood, the provider of cleaning services.
1.2 Client means any individual, business, or organisation that requests or receives cleaning services from the Company.
1.3 Services means domestic or commercial cleaning services and any related services provided by the Company as agreed with the Client.
1.4 Cleaner means any person engaged by the Company to carry out the Services.
1.5 Premises means the property or location where the Services are to be carried out.
1.6 Agreement means the contract between the Company and the Client incorporating these Terms and Conditions.
2. Scope of Services
2.1 The Company provides a range of cleaning services, including but not limited to regular domestic cleaning, one-off deep cleaning, end of tenancy cleaning, office and commercial cleaning, and related tasks agreed at the time of booking.
2.2 The specific scope of work, including the type of service, frequency, duration, and any special instructions, will be agreed between the Company and the Client at the time of booking and confirmed in writing where practicable.
2.3 The Company reserves the right to decline any work that it considers unsafe, unsuitable, or beyond the agreed scope of Services.
3. Booking Process
3.1 Bookings may be made by the Client through the Company’s chosen booking channels. By submitting a booking request, the Client confirms that all information provided is accurate and complete.
3.2 A booking is considered provisional until it is confirmed by the Company. The Company will endeavour to confirm all bookings as soon as reasonably possible.
3.3 The Company does not guarantee the availability of any particular time slot, date, or Cleaner. All bookings are subject to availability.
3.4 For regular cleaning services, the Client will be informed of the proposed schedule. Any changes to regular appointments must be agreed with the Company in advance.
3.5 The Client is responsible for ensuring that the Premises are accessible at the agreed time and that the Cleaner is able to perform the Services without obstruction.
4. Access to the Premises
4.1 The Client must provide safe and adequate access to the Premises at the agreed time of the appointment. This may include providing keys, access codes, or arranging for someone to be present.
4.2 If the Cleaner is unable to gain access to the Premises at the scheduled time, the visit may be treated as a late cancellation and charges may apply in accordance with the cancellation policy set out in these Terms and Conditions.
4.3 The Client is responsible for ensuring that any security systems, alarms, or entry instructions are communicated clearly to the Company in advance of the visit.
5. Client Obligations
5.1 The Client must ensure that the Premises are reasonably tidy and that any items of particular value, fragility, or importance are safely stored or clearly identified.
5.2 The Client will provide access to basic utilities, including electricity and running water, as required for the performance of the Services.
5.3 The Client must inform the Company in advance of any health and safety risks, hazardous materials, or particular conditions at the Premises that may affect the performance of the Services.
5.4 The Client must not directly employ or engage any Cleaner introduced by the Company for cleaning services other than through the Company, for a period of 12 months from the last date the Cleaner carried out Services for the Client on behalf of the Company, unless otherwise agreed in writing.
6. Payments and Charges
6.1 The fees for the Services will be agreed at the time of booking based on the type of service, the duration of the appointment, and the size or condition of the Premises.
6.2 Unless otherwise agreed, charges are calculated on an hourly basis or as a fixed fee for specific services such as end of tenancy cleaning.
6.3 The Company reserves the right to adjust its rates from time to time. For regular Clients, any change in rates will be communicated in advance of the change taking effect.
6.4 Payment terms will be confirmed at the time of booking. The Company may require payment in advance, on the day of the service, or within a specified period after the invoice date.
6.5 Accepted methods of payment will be set out by the Company and may include card payment, bank transfer, or other cashless methods. The Company may decline payment methods at its discretion.
6.6 If payment is not received by the due date, the Company reserves the right to suspend or cancel further Services until the outstanding balance is settled.
6.7 The Company may apply reasonable late payment charges or interest on overdue amounts in accordance with applicable law.
7. Cancellations and Rescheduling
7.1 If the Client wishes to cancel or reschedule an appointment, the Client must provide the Company with reasonable notice. The minimum notice period will be specified at the time of booking.
7.2 Where the Client cancels or reschedules with insufficient notice, the Company reserves the right to charge a cancellation fee, which may be up to the full cost of the booked service.
7.3 If the Cleaner is unable to access the Premises at the agreed time for reasons within the Client’s control, this may be treated as a late cancellation and the relevant cancellation fee may apply.
7.4 The Company reserves the right to cancel or reschedule Services where necessary due to unforeseen circumstances, including but not limited to staff illness, severe weather, or operational issues. In such cases, the Company will endeavour to provide as much notice as possible and to offer an alternative appointment.
7.5 If the Company cancels a booking and is unable to offer a suitable alternative, any pre-paid fees for that appointment will be refunded.
8. Quality of Service and Complaints
8.1 The Company aims to provide a high standard of cleaning services to all Clients in St John's Wood and surrounding areas.
8.2 If the Client is dissatisfied with any aspect of the Services, the Client should contact the Company as soon as possible, and in any event within 24 hours of the service taking place, so that the matter can be investigated.
8.3 Where a complaint is justified, the Company may, at its discretion, offer to re-clean the affected area, provide a partial refund, or make another form of reasonable adjustment.
8.4 The Company’s liability in relation to any complaint is limited as set out in the liability section of these Terms and Conditions.
9. Client Property and Keys
9.1 If the Client provides keys or access devices to the Company, they will be stored and handled with reasonable care.
9.2 The Company accepts no responsibility for any loss or damage arising from the misplacement or misuse of keys or access devices that is not directly attributable to the negligence of the Company or its staff.
9.3 The Client is responsible for ensuring that any keys or access devices supplied are clearly labelled without showing the full address of the Premises.
10. Liability and Insurance
10.1 The Company will exercise reasonable skill and care in the provision of the Services.
10.2 The Company maintains appropriate insurance cover in respect of public liability and, where applicable, employer’s liability, in accordance with legal requirements.
10.3 The Company’s liability for any loss or damage to the Client’s property arising from the provision of the Services shall be limited to direct losses only and shall not exceed the value of the relevant cleaning appointment or the amount recoverable under the Company’s insurance policy, whichever is greater.
10.4 The Company shall not be liable for any indirect or consequential loss, including but not limited to loss of profit, loss of business, or loss of enjoyment.
10.5 The Company shall not be responsible for wear and tear, existing damage, or deterioration of surfaces, fabrics, or materials that may become apparent during or after cleaning.
10.6 The Client must inform the Company of any particularly fragile or high-value items prior to the commencement of the Services. The Company reserves the right to decline cleaning of such items.
10.7 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, or any other liability that cannot be excluded or limited under applicable law.
11. Waste Handling and Environmental Regulations
11.1 The Company will handle and dispose of general waste arising from routine cleaning in accordance with applicable waste and environmental regulations.
11.2 The Services do not include the removal or disposal of hazardous, clinical, or regulated waste, including but not limited to sharps, medical waste, chemicals, asbestos, or building rubble. The Client is responsible for arranging for the proper disposal of such materials through licensed waste carriers.
11.3 The Client must inform the Company in advance if there is any waste on the Premises that may present a health or safety risk or that requires special handling. The Company reserves the right to refuse to handle any such waste.
11.4 The Company will endeavour to use cleaning products that are effective and appropriate for the task. Where the Client supplies their own cleaning products, the Client is responsible for ensuring that such products are safe, suitable, and compliant with relevant regulations.
11.5 The Company encourages responsible use of water, electricity, and cleaning products and will seek to minimise environmental impact where reasonably practicable.
12. Health and Safety
12.1 The Company is committed to maintaining a safe working environment for its Cleaners and Clients.
12.2 Cleaners are instructed to follow health and safety guidelines, including the correct use of cleaning products and equipment.
12.3 The Client must not request any tasks that are unsafe or that fall outside the normal scope of cleaning services, such as lifting excessively heavy items, working at unsafe heights, or handling hazardous materials.
13. Privacy and Data Protection
13.1 The Company will handle any personal information provided by the Client in accordance with applicable data protection laws.
13.2 Personal data will be used for the purposes of managing bookings, providing the Services, improving operations, and fulfilling legal obligations.
13.3 The Company will take reasonable steps to protect personal data against unauthorised access, loss, or misuse.
14. Amendments to These Terms
14.1 The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, best practice, or the operation of its services.
14.2 The current version of the Terms and Conditions will apply to all bookings. Where changes materially affect existing Clients, the Company will endeavour to notify such Clients in advance.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
16. General Provisions
16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining provisions, which will continue to be valid and enforceable.
16.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy.
16.3 The Agreement is between the Company and the Client and is not intended to confer any rights on any third party.
16.4 These Terms and Conditions constitute the entire agreement between the Company and the Client in relation to the provision of cleaning services in St John's Wood and surrounding areas and supersede any prior understandings or arrangements.
